West Bengal Open Access Regulations (Consolidated) - 2007

HIGHLIGHTS

Eligibility to seek Open Access (OA)	Licensee, or a generating company, or a captive generating plant, or a consumer, or any person engaged in the business of supplying electricity to the public under the Act or any other law for the time being in force, or any other person, shall be eligible for open access on payment of appropriate charges as determined by the Commission from time to time.

Connectivity Charges and Procedure	Capacity available shall be determined considering maximum load recorded vis-à-vis safe capacity of such system, load growth potential, capacity already allotted to OA, requirements according to State Grid Code, and evacuation network available. Applicant shall bear all expenses incurred. For LTOA: Access for wheeling shall be allowed if the capacity of the distribution system concerned supports such wheeling in accordance with the different technical guidelines on sub-transmission and distribution network declared by the Authority.
Nodal Agency	Long Term Open Access: STU - if transmission system is used. Else transmission or distribution licensee in whose system the point of drawal is located. Short Term Open Access: SLDC (State Load Dispatch Centre).
Procedure and Charges for Long Term Open Access (LTOA)	Applicability: Open Access for a period of 15 years or more. Shall be allowed in accordance with transmission planning criteria mentioned in State Grid Code. The applicant shall bear the actual expenditure incurred by the licensee for system strengthening within the limit of cost estimate intimated by the licensee concerned. Actual expenditure shall be subject to the scrutiny of the Commission. Adjustments, if any, will be made accordingly within the ceiling of 105% of the cost estimate. Applicant shall apply to nodal agency as per location of injection and drawal points, , as per table below

	Time frame for processing application: 30 days. Surrender of OA capacity: Consumer shall pay full charge for scheduling and system operation, as has been fixed by the Commission from time to time, on full open access capacity allotted to him for the remaining period of the allocation. However, if the unutilized capacity is being used by any other OA customer or any licensee, proportional charges are to be borne by the original OA customer to the extent of under-utilisation.
Procedure and Charges for Medium Term Open Access (MTOA)	-NA-
Procedure and Charges for Short Term Open Access (STOA)	Applicability: Open Access for a period not exceeding 4 months at a stretch. No provision for system strengthening, and OA is granted subject to capacity availability. If Open Access is commencing in the first to fourth month, and such open access is not ending beyond the fourth month, taking the month in which the application is made as the first month. Applicant shall apply to nodal agency as per the location of injection and drawal points .

	In case of congestion, allotment shall be made by inviting bids from applicants. Time Frame: 2 days for STOA of term up to one week, and 3 days if term is more than a week. Surrender of OA capacity: Consumer shall pay full charge for scheduling and system operation, as has been fixed by the Commission from time to time, on full open access capacity allotted to him for the remaining period of the allocation. However, if the unutilized capacity is being used by any other OA customer or any licensee, proportional charges are to be borne by the original OA customer to the extent of under-utilisation.

OTHER PROVISIONS

Allotment priority	1. A distribution licensee, to the extent of its requirement for its consumers within the State and for supplying power to other licensees. 2. Power, fully based on cogeneration within the State. 3. Power, fully based on wind. 4. Power, fully based on hydro. 5. Power, fully based on renewable sources other than hydro and wind. 6. Power from captive generation based on gas. 7. Power from captive generation based on coal. 8. Power from captive generation based on oil. 9. Other sources, if any, not covered above. Within category, priority shall be on first-come-first-served basis. Long term open access applicants shall have priority over short term.
Open Access charges	Transmission Charges Rs./MW/month for Long Term customers and in Rs./MW/day for Short Term customers on the basis of MW served by the system. For Long Term Open Access : Rs.1,63,374.36/MW/month. For Short Term Open Access :Rs. 1361.45/MW/day. For uncongested STOA.
	Up to 6 hours, in a day, in one block.	1/4^th of transmission charges of relevant short term customer.
	More than 6 hours and up to 12 hours a day, in a block.	½ of transmission charges of relevant short term customer.
	More than 12 hours in a day.	Equal to transmission charges of relevant short term customer.
	Wheeling Charges Payable on actual energy drawal as per the relevant tariff order.
Scheduling and Metering	Scheduling A twenty-hour day-ahead schedule shall be submitted by the OA customer for both drawal and injection of active power on 15-minute time block basis to the SLDC, as specified in the Tariff Regulations. SLDC charges: Re.0.5 /kWh. Metering: · Connected licensee(s) shall provide the ABT compliant main meters and check meters as per directions of nodal agency, at interconnection points, cost of meters to be borne by OA consumer.
Energy losses	Transmission Losses WBSETCL loss: 3.40%. Distribution Losses CESC: Revised distribution loss norm – 14.30%. WBSEDCL: Distribution loss – 17.50%.
Imbalance and Reactive Energy charges	Imbalance Energy Charges Un-scheduled interchange charges for deviation from the schedule shall be paid at such rates as specified in the Tariff Regulations. Energy accounting will be as per Balancing and Settlement Code, as specified in the Tariff Regulations. Reactive Energy Charges If the voltage at the point of drawal is below 97% of the normal voltage, the OA customer shall pay the concerned licensee for drawal of reactive energy at the drawal point at a rate stipulated in the Tariff Order issued by the Commission. If at the injection point the voltage is higher than 103% of normal voltage, the OA customer shall pay the concerned licensee for injection of reactive energy at the point of injection at a rate stipulated in the Tariff Order issued by the Commission. Both drawal and injection of reactive energy shall be measured in 15-minute time blocks along with voltage.
